Equitable distribution is the distribution of property, assets and debt when considering assets in a divorce proceeding. Equitable distribution is based on equity and not equality. As one may expect, equity can take on many forms.
The determination of equitable distribution takes into consideration the future financial situation of each spouse after entry of the divorce decree.
